Complaints Procedures

Where a client is dissatisfied with his/her Attorney’s representation and alleges some form of professional misconduct, he/she may file a complaint against the Attorney with the Disciplinary Committee at the High Court Registry. In such cases, complainants are to be guided by the following procedure:

  1. An application form (Form 1 –Application Against an Attorney-at-Law) and supporting affidavit (Form 2 – Affidavit by Applicant) are to be completed, each in triplicate. Affidavits must be sworn before a Notary Royal or Justice of the Peace.

  2. The completed forms are to be filed at the High Court Office. One set will be returned to the complainant for his/her records. Documents may be filed at the Court Office between 9:00 am and 2:00 pm Monday through Thursday, and until 3:00 pm on a Friday. The Court’s filing fees are as follows:
    (a) Form 1 - Application Against an Attorney at Law $10.00
    (b) Form 2 - Affidavit by Applicant $7.50
      TOTAL $17.50

    Fees are to be paid in the form of stamps (1 - $10.00, 1 - $5.00, 1 - $2.50 stamps), which may be purchased from the Court Office or the General Post Office on Bridge Street, Castries. Foreign stamps may not be used.

  3. Within seven (7) days of the application being filed, the complainant will be notified of the date set for his/her hearing if, following an initial review of his/her case, the Committee considers the matter to have merit. Upon receiving a Notice of Hearing (Form 3), he/she must provide the Secretary of the Disciplinary Committee with a list of any documents he/she intends to rely on during his/her hearing. Note that the list must be submitted at least seven (7) days before the set hearing date.

  4. The Attorney against whom the complaint was brought would also need to provide his/her list of documents. Both the Attorney and the complainant may inspect each other’s list, and either person can apply for a copy of one or more documents on the other’s list. Once an application is made, the documents must be provided within three (3) days.
